The Alaska Democratic Party Offers Settlement to DOE
FOR IMMEDIATE RELEASE
Wednesday, October 27, 2010
THE ALASKA DEMOCRATIC PARTY OFFERS SETTLEMENT TO DOE
The ADP Wants Alaska to Focus on Moving Forward in This Election
(Anchorage, Alaska) – The Alaska Democratic Party (ADP) has offered a settlement to the Division of Elections (DOE) regarding the Alaska Superior Court’s decision and order.
“It is in the best interest of Alaskans in this election for the DOE to comply with the Superior Court’s clear decision. We are offering a settlement that will entirely resolve this important election dispute so that Alaskans can go forward casting their ballots legally,” said Patti Higgins, Chair of the Alaska Democratic Party.
The attorney for the ADP Tom Daniel sent an email to Margaret Paton-Walsh late this morning offering the following settlement:
“The Alaska Democratic Party would like to suggest a settlement along the following lines:
a. The Division cease using the write-in sheet immediately
b. The Division pay our reasonable attorney fees and costs
c. ADP will agree that the ballots already cast, including the Homer ballots, can be counted normally.”
During the final days of early voting and on the days leading up to November 2, Alaska needs to concentrate on administering this election in a way that is fair and legal.
“The ADP offered this settlement so that the DOE can move forward with administering this important election and so that Alaska voters can move forward in participating in this important election,” Higgins stated. “Our concern that the write-in list was present in polling locations has been definitively addressed by the Alaska Superior Court. Now, the voting process can and should continue in the fair and legal way it is intended.”
The Conclusion in Section V of the Decision and Order issued by Superior Court Judge Pfiffner states:
“ADP is entitled to and is hereby granted a temporary restraining order enjoining the Division from disseminating and using lists of write-in candidates at all polling places in the State of Alaska relative to the November, 2010, general election.”
